1. Contracting Party
These Terms & Conditions (“Terms”) govern all bookings made with Butiama & Beyond LLC (“Company,” “we,” “us,” or “our”). By booking a trip through our website, you acknowledge that you have read, understood, and agree to these Terms.
2. Services Provided
Butiama & Beyond LLC operates as a U.S.-based travel facilitator partnering with Butiama Cultural Tourism and other on-the-ground suppliers located in Tanzania to deliver travel and tour services. We arrange itineraries, accommodations, transportation, activities, and related travel components on your behalf.
3. Booking & Payments
Full payment is required at the time of booking to confirm participation. Payments are processed securely through third-party platforms including Stripe and Affirm (financing). By completing checkout, you authorize these platforms to charge your selected payment method.
4. Pricing & Currency
All prices listed on our website are in U.S. Dollars (USD) unless otherwise stated. Prices are subject to change due to supplier adjustments, exchange rate fluctuations, fuel surcharges, or tax changes. Once payment is completed, pricing is considered final and locked.
5. Cancellation & Refunds
Our cancellation policy is detailed separately and forms part of these Terms. All refunds, when applicable, will follow the refund schedule described in our Cancellation & Refund Policy.
6. Changes & Amendments by the Traveler
Adjustments to travel dates, accommodations, or itinerary components are subject to availability and may incur additional fees. Change requests must be submitted in writing via email.
7. Travel Insurance Requirement
We strongly recommend that travelers purchase comprehensive travel insurance covering trip cancellation, interruption, medical expenses, repatriation, and evacuation. Some destinations may require proof of insurance for entry or participation.
8. Traveler Responsibilities
Travelers are responsible for ensuring compliance with all entry requirements including passports, visas, vaccinations, and health certifications. Failure to meet entry requirements does not constitute grounds for a refund.
9. Medical Fitness to Travel
By booking, you certify that you are medically fit to participate in the selected activities and itinerary. Some activities (e.g., safaris, trekking, water activities) may involve physical exertion and exposure to outdoor environments.
10. Supplier & Operational Control
While Butiama & Beyond LLC facilitates bookings, the delivery of travel services is executed by suppliers, including but not limited to Butiama Cultural Tourism. These suppliers maintain operational control and may adjust itineraries due to safety, weather, logistics, or unforeseen circumstances.
11. Force Majeure
We are not liable for losses or delays arising from events outside our reasonable control including natural disasters, pandemics, civil unrest, weather, border closures, or government actions.
12. Assumption of Risk & Liability Limitation
Participation in travel activities may involve known and unknown risks. By booking, you agree to voluntarily assume such risks and release Butiama & Beyond LLC from liability to the fullest extent permitted by law.
13. Children & Minors
Travelers under 18 must be accompanied by a parent or legal guardian unless written consent is provided.
14. Dispute Resolution
These Terms shall be governed by the laws of the State of Maryland, and any disputes shall be resolved through binding arbitration in that jurisdiction. Travelers waive the right to participate in class actions against Butiama & Beyond LLC.
15. Amendments to Terms
We reserve the right to update these Terms. Any changes will apply to new bookings from the date of publication.
16. Photo Media Release
During travel, photographs or videos may be taken for promotional purposes. By booking, you grant Butiama & Beyond LLC permission to use such media for marketing unless you request otherwise in writing prior to travel.
